Terms and Conditions

UAE Consumer Rights Notice

At HOSÄENA, we intend to conduct our business in a transparent and fair manner, including during the Private Alpha phase.

HOSÄENA is operated by FBG International Trading LLC, a company registered in the United Arab Emirates.

As a customer, you may have statutory consumer rights under applicable UAE consumer protection laws, including rights relating to clear information, accurate product descriptions, price transparency, defective or non-conforming goods, and remedies that may include repair, replacement, or refund where applicable.

Nothing in our Shipping Policy, Terms of Sale, Returns & Refunds Policy, Curated Objects Logistics Terms, Checkout Disclosures, or any other customer-facing terms is intended to limit, exclude, or waive rights that cannot legally be limited, excluded, or waived under applicable law.

If any provision in our policies conflicts with mandatory statutory rights that apply to you, those statutory rights will prevail.

Private Alpha participation does not remove statutory consumer rights where real payment, real goods, or real delivery are involved.

Terms of Sale

Applies to: Orders placed with HOSÄENA during the Private Alpha phase.

These Terms of Sale apply when you place an order with HOSÄENA. Please read these Terms together with our Shipping Policy, Returns & Refunds Policy, Curated Objects Logistics Terms where applicable, Privacy Policy, and Checkout Disclosures.

2.1 About HOSÄENA

HOSÄENA is operated by:

In these Terms, “HOSÄENA,” “we,” “us,” and “our” refer to FBG International Trading LLC trading as HOSÄENA.

2.2 Private Alpha Status

HOSÄENA’s Private Alpha phase may involve selected participants, limited operational workflows, case-by-case order handling, international fulfillment, manual review, and evolving systems.

However, where real payment, real products, or real shipment occur, the Private Alpha status does not remove statutory consumer rights that apply under law.

2.3 Order Placement and Acceptance

When you place an order, you are submitting a request to purchase. All orders are subject to review and acceptance by HOSÄENA.

We may refuse, cancel, or hold an order before dispatch where necessary, including for reasons relating to:

  • product availability
  • pricing or listing error
  • payment issue
  • shipping feasibility
  • destination restrictions
  • customs or import risk
  • suspected fraud or misuse
  • Curated Objects or special-item logistics
  • legal, regulatory, or operational constraints

An order is accepted only when HOSÄENA confirms acceptance in writing.

Payment confirmation, checkout completion, or automated receipt does not by itself guarantee order acceptance, dispatch, delivery, or shipping availability.

2.4 Pricing and Payment

Prices are shown in the currency displayed at checkout or in written order communications.

Payment must be made using the payment methods made available by HOSÄENA for the relevant order.

For bank transfer orders, goods will not be dispatched until cleared funds are received.

HOSÄENA may decline or cancel an order if payment is not received, cannot be verified, is reversed, or appears irregular.

2.5 Shipping

Shipping is governed by the Shipping Policy.

Shipping is case-by-case, item-dependent, and destination-dependent.

Shipping availability is not guaranteed for every destination or every item.

For Curated Objects, high-value, oversized, fragile, bespoke, commissioned, or special-handling items, HOSÄENA may require separate logistics review before dispatch.

2.6 Duties, Taxes, Customs, and Import Charges

For international shipments, duties, taxes, customs brokerage fees, import charges, clearance requirements, or destination-specific charges may apply.

To the extent permitted by applicable law and unless expressly stated otherwise at checkout or in written order communications, the customer is responsible for applicable destination-country duties, taxes, customs fees, brokerage charges, and import charges.

HOSÄENA does not guarantee:

  • customs clearance
  • the amount of customs or import charges
  • absence of duties or taxes
  • customs processing timelines
  • delivery timelines affected by customs
  • successful import into every destination

2.7 Risk and Title

Risk of loss and title should be interpreted together with the Shipping Policy, the specific order communications, and applicable law.

As a conservative operational position, HOSÄENA will not treat risk/title transfer language as a waiver of statutory consumer rights.

For standard shipments, risk of loss may be treated as passing upon delivery to the delivery address provided, to the extent permitted by applicable law and subject to rights that cannot be excluded.

Curated Objects, high-value items, collected items, or special logistics arrangements may require object-specific terms.

No “vault door,” “collector assumes all risk,” or blanket risk-transfer language should be used.

2.8 Returns and Refunds

Returns and refunds are governed by the Returns & Refunds Policy.

Nothing in these Terms removes rights that cannot legally be limited under applicable consumer protection law.

2.9 Curated Objects

Curated Objects and other high-value or specially handled items may be subject to additional logistics, payment, condition, inspection, shipping, and return terms.

Curated Objects are not standard checkout products unless HOSÄENA explicitly makes them available for purchase through an approved order process.

Curated Objects may be generally treated as final sale only to the extent permitted by applicable law and subject to statutory rights.

2.10 Product Information

HOSÄENA aims to provide accurate product information, including descriptions, materials, dimensions, pricing, care notes, and availability where applicable.

Some product details may be based on handmade, natural, vintage, rare, or object-specific characteristics.

Minor variation may occur where clearly disclosed and legally permissible.

Product descriptions, images, care information, and provenance statements must not be read as guarantees beyond what is expressly stated and legally required.

2.11 Intellectual Property

All website content, including text, photography, product descriptions, design, layout, marks, names, logos, and editorial material, is owned by or licensed to HOSÄENA unless otherwise stated.

You may not copy, reproduce, distribute, commercially use, or adapt HOSÄENA content without written permission.

2.12 Limitation of Liability

To the extent permitted by applicable law, HOSÄENA is not liable for indirect, incidental, special, or consequential losses.

To the extent permitted by applicable law, HOSÄENA’s liability for a specific order should not exceed the amount paid for that order.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including mandatory statutory consumer rights.

2.13 Governing Law and Dispute Resolution

These Terms are intended to be governed by the laws of the United Arab Emirates.

Any dispute should be handled through appropriate UAE dispute-resolution or court channels, unless mandatory law requires otherwise.

HOSÄENA will attempt to resolve customer concerns fairly through Care & Support before escalation where appropriate.

Curated Objects Logistics Terms

Applies to: Curated Objects and selected high-value, fragile, rare, bespoke, commissioned, or specially handled pieces.

These terms apply in addition to the Shipping Policy, Terms of Sale, and Returns & Refunds Policy where a Curated Object is offered for purchase.

Curated Objects are not standard merchandise. They may require individual review, condition documentation, special handling, personalized logistics, and separate return treatment.

Nothing in these terms limits statutory rights that cannot legally be excluded.

5.1 Nature of Curated Objects

Curated Objects may include rare, high-value, fragile, bespoke, commissioned, founder-held, house-selected, or specially sourced pieces.

Each Curated Object is handled case-by-case.

HOSÄENA does not guarantee that every Curated Object can be shipped to every destination.

5.2 Pre-Purchase and Pre-Dispatch Review

Before dispatch of a Curated Object, HOSÄENA may provide object-specific documentation where available, such as:

  • description
  • photographs
  • material notes
  • provenance notes, where supported
  • care guidance
  • condition notes or condition report, where available
  • logistics notes
  • shipping quote

Condition reports are conditional.

A condition report should be referenced only where such a report exists for the specific object.

No statement should imply that every Curated Object will always include a complete condition report unless HOSÄENA operationally commits to that standard.

5.3 Condition Reports

Where a condition report is provided, it is intended to help describe the object’s condition before dispatch.

It is not a waiver of statutory rights.

It is not a blanket liability cutoff.

It does not remove rights relating to damage, defect, misdescription, or non-conformity where such rights apply by law.

5.4 Packaging and Fulfillment

Curated Objects may be handled through HOSÄENA’s authorized fulfillment partner or logistics provider.

Depending on the object, destination, and operational feasibility, logistics may include:

  • enhanced packing
  • custom crating
  • condition documentation
  • signature delivery
  • special handling
  • insurance review
  • personalized shipping quote
  • destination-specific assessment

These are not guaranteed for every object.

They apply only where confirmed for the relevant object before dispatch.

5.5 Insurance

Curated Objects may be insured during transit where insurance is available, arranged, and confirmed for the relevant object.

Insurance is not automatically guaranteed.

Coverage amount, exclusions, claims process, documentation requirements, and carrier or insurer decisions may vary.

Any insurance details should be confirmed in writing before dispatch where applicable.

HOSÄENA does not guarantee insurance recovery, claim approval, replacement, refund, or carrier/insurer outcome.

5.6 Delivery and Acceptance

Curated Objects may require signature confirmation or receipt by an authorized adult representative where available and appropriate.

Customers should inspect packaging on delivery where possible and notify HOSÄENA promptly if visible damage is present.

Failure to inspect immediately does not automatically waive statutory rights, but prompt notice and evidence may help HOSÄENA investigate.

5.7 Returns

Curated Objects are generally treated as final sale to the extent permitted by applicable law.

Returns may be considered where:

  • the object arrives significantly damaged
  • the object materially differs from confirmed documentation
  • the object is defective or non-conforming under applicable law
  • HOSÄENA agrees in writing
  • applicable law requires a remedy

Returns for change of mind may not be accepted for Curated Objects unless HOSÄENA expressly agrees or applicable law requires otherwise.

5.8 Risk and Title

Risk and title for Curated Objects should be handled under the Terms of Sale and any object-specific written arrangement.

No blanket “vault door” or “collector assumes all risk” language should be used.

Any risk/title statement must preserve statutory consumer rights and should be interpreted to the extent permitted by applicable law.

5.9 Care After Delivery

Curated Objects may come with care guidance where available.

HOSÄENA is not responsible for damage caused after delivery by misuse, improper handling, unsuitable storage, environmental exposure, alteration, or third-party handling, to the extent permitted by applicable law.
